Prison Blog About the BC Election Held on Tuesday, May 14, 2013

submitted by on May 16, 2013

Marc Emery BCMP The Toronto Maple Leafs' historic record as biggest losers in a single game lasted all of one day until the BC New Democratic Party took the title away from them in an even more breathtaking fashion.

In a situation that must have deposed BC NDP leader Carole James smirking today, she – whom, according to the rebels like Jenny Kwan, Adrian Dix and others, couldn't win an election in BC (despite taking the BC NDP from 2 seats in 2001 to 40 seats in 2009) – won her seat while the BC NDP collapsed spectacularly in unprecedented way.

The NDP was 20 points ahead of the Liberals only six weeks ago. Twenty points! And yet, after election night last night, the NDP was five percentage points behind, and 17 seats behind, a collapse of 25% of the electorate. The Liberals had 45 seats to the NDP's 40 seats before the May 14 vote. Now it's 50 Liberals – and of course, this is really the Socred alliance, as the Conservative vote collapsed and fell in line behind the BC Liberals, whose candidates by and large are even more conservative (in the bad way) than the new BC Conservative party.

Current BC NDP leader Adrian Dix has to be the most uninspiring, charisma lacking, vacant 'leader' ever, and offered up nothing to the voters of BC that could inspire confidence. No policies, no platform, no campaign. "Just let the Liberals implode" was the whole BC NDP campaign. Astonishing arrogance, such hubris!

The BC Greens have a new leader and their first Member of the Legislative Assembly (MLA) in climate scientist Andrew Weaver, elected in Oak Bay-Gordon Head, a riding that overlaps federal Green Party leader Elizabeth May's Saanich-Gulf Islands riding. This is great news for the BC Greens, who have been declining in popularity since the 2001 election campaign when they received more than 12% of the BC vote. It dropped to 9% in 2005, then 8% in 2009 and 8% in 2013 under Jane Sterk's unfortunately inadequate (and largely invisible) leadership.

The BC Greens could have had a higher percentage but for an unexplainable decision not to run candidates in every BC riding. Huge gaps across the province, in areas like the two ridings in my wife's hometown Kamloops, did not have a Green candidate – which left a lot of people disappointed. Had the Greens run in all 85 ridings, I believe the total would have exceeded 10% of the total provincial vote. Hopefully in the next election, four years from now, the BC Greens will have a candidate in every riding.

Jodie Emery BC Green Party 2013I am particularly proud of my wife Jodie and her campaign in Vancouver-West End as the BC Green candidate. Despite so much going on in her regular life, Jodie campaigned every day for the final 15 days of the campaign with a shoestring budget of her own money, and received 1,897 votes for 11.1% of the riding total. (Absentee ballots will be counted in the next two weeks and then added to all candidates' vote totals across BC.) That was an increase over the previous 9% result for the riding, and a doubling of her own personal total of 904 votes in the 2009 BC election campaign as the BC Green candidate in Vancouver-Fraserview.

The BC Green Party under Jane Sterk's 'leadership' failed to marshal any resources for anything resembling a worthy campaign province-wide, and left all of the candidates outside of four in southern Vancouver Island to fend for themselves. Sterk will resign in the days ahead, an inevitability after going nowhere with the party in five frustratingly ineffective years in charge of the BC Green franchise, and Andrew Weaver will be de facto BC Green Party leader. He'll have the prestige of being a veritable Nobel prize-winning climate change scientist and now MLA for the next four years, and in that time I hope he'll inspire the next wave of BC Green candidates for the May 2017 election. (In fairness to Jane Sterk, the first Green MLA in BC has been elected under her party leadership, but there isn't any other accomplishment to note.)

The BC Greens are far more progressive on almost every issue than the BC NDP, who are still the proxy for organized labour unions. As to the BC Liberals, leader Christy Clark proved that chutzpah can win elections. She lost her own seat to BC Civil Liberties Association lawyer and NDP candidate David Eby, so some poor sap of a Liberal MLA will have to give up their safe Liberal seat so Clark can parachute into it and get a seat in the Legislature. Some lucrative government appointment awaits some lucky BC Liberal MLA!

Clark won by standing up for something while the BC NDP seemed to stand for nothing. The Liberals hammered the NDP for its apparent policy-less drift, and the accusation resonated with voters. Premier Christy Clark has done the Boston Bruins one better, no doubt – a political come-from-behind that I doubt is equaled in any province over the last 30 years. It's a shame that her government is filled with regressive troglodytes like Mary Polok, Rich Coleman, RCMP-kissy-face Daryl Plecas, and numerous others.

But the Liberals also now have former Vancouver Mayor Sam Sullivan, who (if he resists being whipped into line by Premier Clark) actually believes in legalization and ending prohibition. And the drug policy reform movement has another hope in newly-elected BC NDP MLA David Eby, but both of these two parties are so controlled by (largely inept and corrupt) leadership that I doubt we'll ever hear Sullivan or Eby seriously ever criticize the police or prohibition ever again, and certainly not while in the legislature. As former Liberal MLA Kash Heed showed, and current NDP MLA Nicholas Simons reminded us, the Legislature is where anti-prohibitionists go to "shut up and never be heard from again" in any meaningful and relevant way.

Thankfully, this was the last election in the USA or Canada that I'll ever be absent from participating in as a result of my current exile. I'm excited to be Jodie's campaign manager if she seeks to run in Canada's 2015 federal election as the Green Party candidate for Vancouver Center, which includes all of the provincial riding Vancouver-West End where she ran in this time. We'll raise serious money to do an effective election campaign with mail-outs, phone banking, advertising, more buttons and signs, and an organized volunteer campaign. Jodie and I have worked together for our entire relationship as a "campaigning couple", and she did her best in this election while I've been imprisoned so far away, but I know we're both eager for my return home so we can campaign as a team again.

Marc Continues his Band Performances in Yazoo Prison

submitted by on May 1, 2013

Marc Emery prison band YazooI'm pleased to report that my previous blog, on the origins of 4/20 celebrations, appeared on the Huffington Post under my name. My 4/20 blog was online at CannabisCulture.com for three weeks in the run-up to the worldwide celebration on Saturday, April 20, which attracted a larger attendance and more media throughout North America than ever before.

This blog was delayed for some weeks as a consequence. It's a much more personal piece about my rock and roll band here in an American federal prison, and goes with the new photos of me and my band in the prison music studio. The name of the band is Yazoo, and our most recent concert was on Saturday, March 16th. It was our 13th concert since our first performance on July 2nd, 2011. The show was done under gloriously sunny skies from 12:30pm to 3:00pm in the 'inner' rec yard, in temperatures of about 75 degrees Fahrenheit (23C) – a perfect day, and we all felt it was one of best concerts ever. This is our set list for that show:

Boys Are Back in Town (Thin Lizzy)
Last Resort (Papa Roach)
Blues Deluxe (Joe Bonnamesa)
Black Magic Woman (Santana)
Crazy Train (Ozzy)
Enter Sandman (Metallica)
Heartbreaker/Living Loving Maid (Led Zeppelin)
Kryptonite (3 Doors Down)
Green River (Credence Clearwater Revival)
Texas Flood (Stevie Ray Vaughan)
Running Down a Dream (Tom Petty)
Come Together (Beatles)
Plush (Stone Temple Pilots)
Stormy Monday (Allman Brothers version)
Jumpin Jack Flash (Rolling Stones)
Sunshine of Your love (Cream)
Sweet Home Alabama (Lynyrd Skynyrd)
Pride & Joy (Stevie Ray)
Purple Haze (Jimi Hendrix)
Voodoo Child (Jimi Hendrix)

Marc prison band yazooIn early March, we were able to take photographs of our band performing in the band rehearsal room (the photos that accompany this blog). All the equipment in the music program, and all equipment or recreational items used by the inmates, are paid for by the inmates expenditures at the commissary (the inmate grocery store). After all costs of service and goods sold at the commissary are deducted, the profits of the inmate store are used to finance all recreational activities in the prison, including televisions, cable programming, all athletic equipment, music equipment, pool tables, exercise equipment, and so on.

My band gets to use the band rehearsal room for 3-4 hours on Thursdays, and we practice in the rec area every day for 1-3 hours daily individually or in pairs. Our songs are done note-for-note like the originals, except we usually have a solo by Terry or Don, and then an outro solo by the other, so a number of our songs will have two solos (like Enter Sandman, Voodoo Child, Texas Flood, Running Down a Dream, and Stormy Monday). Most of the others are identical to the recorded version, except we develop an ending in the case of a recorded version that fades out.

Our vocalist for most songs is Chap (Robert Chappell), whom you can see in the main band photo (at the top of this blog) singing 'Red House' (Jimi Hendrix) in the band rehearsal room. Chap is an excellent guitarist and a terrific bass player, much better than me, but fortunately (for me!) he is busy doing the vocal chores for the band, and plays the lead or rhythm guitar when Don sings.

Doing back-up vocalist and playing rhythm/lead guitar is Don Salisbury, whom you can see singing in the photo to the right; in that instance he is singing 'Green River' by CCR. Don is working on hard on his singing and gets two to three songs to sing in each set. Usually though, Don alternates with guitarist Terry for rhythm (when Terry is playing lead) and lead (when Terry is playing rhythm). Don's forte is the blues guitar, and Don often reminds me of how Eric Clapton plays.

Marc prison band YazooOur drummer, Jermaine Moss, known to all here as Sapp, is a remarkably talented drummer with great instincts. Unlike the rest of the band, who get to practice up to several hours a day on our instruments or voices outside of the studio, there is no drum practice opportunity so he gets only the two and a half hours weekly at our band rehearsal, and performance at our concert. Yet Sapp is so talented he can pick up an entire song by hearing it just once, or often having never heard the song, he intuitively understands where a song is supposed to go, and makes playing bass so much easier for me, as he cues me on each change in a song. Getting an action shot for Sapp was difficult, because the snare and kick drums are out of view, and only one shot out of several caught Sapp with the drum sticks in motion.

Terry Griffith is our lead guitarist, but Terry is really the lead musician in the band. Terry is the most accomplished guitarist among three excellent guitarists, and the teacher to the others, as he has played for almost 30 years and understands scales and guitar theory the most. Terry played professionally in bands for about 15 years on the outside, most notably in a band called Rags & Bush Doctor, a Spokane-area band. Terry can play any kind of genre very well, and is also an outstanding bass player and composer of bass lines. When I have to come up with a bass line to a song, and no bass sheet music exists for it, Terry will listen to the song for 30 minutes and then be able to teach me how the bass lines go.

Yazoo prison band While all the others have ten years to near 30 years experience as musicians, I have only 22 months experience on the bass. Prior to that I had never picked up an instrument in my life, nor did I think I had any talent to ever play an instrument. I may not have much talent really, but I have a very good memory and a real desire to play.

I am thrilled every day to actually be in a band with musicians of this outstanding caliber. But their ability to quickly learn a song puts pressure on me to catch on quickly. So I have tended to sacrifice my theory education (major and minor scales, pentatonic scales, modes) in order to spend my time learning songs.

Although I use a Carvin electric bass in the band rehearsal studio and in our outdoor concerts, I practice daily on these big unwieldy acoustic basses. I don't have the finger memory that Chap, Don and Terry have; when they play they rarely look at their guitars, they know where their fingers are and where they are going to. I can look away for a period of time on a simpler bass line, as in Running Down A Dream (Tom Petty), but something like Black Magic Woman, Stormy Monday, Texas Flood, Heartbreaker, etc., I cannot look away from the bass because I will not hit the correct fret with accuracy if I'm not looking.

So that's why most photos of me are me staring at the bass. I know in performance you are supposed to look at the audience, but if I do that for any length of time, I will hit some sour notes – and boy, when you hit a wrong note, you can sure hear it! When anyone in the band hits a wrong note, or wrong chord, it's very noticeable to the other musicians.

Our next concert is around the Memorial Day weekend, likely on Saturday, May 25th. We have added a considerable number of songs to our repertoire since our last show in March. I have been practicing about three hours a day and the increased practice time is paying off. Here is our set list for the Memorial Day show:

Marc Emery prison band Yazoo1. Panama (Van Halen)
2. Sharp Dressed Man (ZZ Top)
3. Black Magic Woman/Gypsy Queen (Santana)
4. Enter Sandman (Metallica)
5. Heartbreaker/Living Loving Maid (Led Zeppelin)
6. Peace of Mind (Boston)
7. Last Resort (Papa Roach)
8. White Wedding (Billy Idol)
9. Blues Deluxe (Joe Bonnamesa)
10. Your Disease (Saliva)
11. Classical Gas (Mason Williams) solo by Terry
12. Green River (Credence Clearwater Revival) Don on vocals/Chap on guitar
13. Tuesday's Gone (Lynyrd Skynyrd) Don on vocals/Chap on guitar
14. Only God Knows Why (Kid Rock) Don on vocals/Chap guitar
15. Boys are Back in Town (Thin Lizzy)
16. Come As You Are (Nirvana)
17. You Really Got Me/Ain't Talking Bout Love (Van Halen medley)
18. Crazy Train (Ozzy Osbourne)
19. Texas Flood (Stevie Ray Vaughan)
20. Whole Lotta Love (Led Zeppelin)
21. Voodoo Child (Led Zeppelin)

prison band Yazoo My band needs guitar tab books, which are collections of songs in sheet music that we can learn songs from, that we will later perform. If you, dear reader, would like to send a guitar or bass tab book from Amazon or any book store (as all materials must come from a store of some kind, since individuals cannot send anything personally by mail except letters and photos), please check out my Amazon.com wishlist.

Any music tab books there that you care to send would be greatly appreciated. My future ambition is that the songs I learn to play here will be performed when I’m in a band at the BCMP Lounge, once I have returned home. And then you can see me play the bass in a rock and roll band that the free world will be able to hear!

The Origins of April 20th as a Day of Celebrating Cannabis

submitted by on April 4, 2013

Marc speaks at a rally in VancouverThe biggest celebration day in the cannabis culture is April 20. The April 20 (4/20) celebration originally started in the mid 1970s as the time of day after school, 4:20 pm, for high school students in San Rafael, California to meet to smoke pot. The phrase "I'll see at you at 4:20" became code for, "I'll be there to smoke a joint with you after classes are over".

As these students graduated and moved beyond the parochial boundaries of high school, the use of the term 4:20 showed up discreetly on a few California college campuses, but more noticeably among the ritualistic canon of the 'Deadhead' culture – that is, followers of the band The Grateful Dead. These fans made a lifestyle of following the band tour across America (and Europe), consuming LSD and lots of pot before, during and after these often-lengthy concerts, and were the first to incorporate the term '4:20' into every day vernacular.

By the mid-1980's, an any Dead tour, or Rainbow gathering, you could hear the usually rhetorical question "What time is it?" and the response was, if you were hip, "Four twenty!", no matter what time it was according to Greenwich Mean Time (the official clock time). Then a joint would be produced and smoked. At the actual 4:20pm, a cry went out, "Four-twennnttttttyyyyyy!", as it does now a million times every day upon every hour as 4:20pm occurs in each consecutive time zone across the earth. It's no exaggeration to say that a cry of "Four-Twenty!" is exhorted in 2013 in every hamlet, village, town, city, campus, on the planet every day at the magical time of twenty-after-four in the afternoon.

But the advent of worldwide celebrations taking up an entire day on April 20 is a bit more recent in our cultural history.

On July 7, 1994, I opened the HEMP BC store at 324 West Hastings. This was a historic development, as the Canadian government had banned the distribution of all marijuana books, magazines, literature, bongs, pipes and all aspects of the cannabis culture in 1987 – ending the distribution of High Times in Canada, closing all pipe and bong and "head" shops in all of Canada, and even banning the distribution of Jack Herer's vital ground-breaking work "The Emperor Wears No Clothes".

Underneath the big HEMP BC sign at 324 West Hastings was the slogan "The Marijuana & Hemp Center For Greater Vancouver". My first employees were Ian Hunter, a local activist, and two 'Deadheads' named Danna Rozek and Cindy Lassu. All of our behavior in those days was considered revolutionary. Everything we sold was illegal, but we proudly said "All of these pipes are for smoking marijuana. We do not endorse tobacco use." We smuggled High Times magazine into Canada and sold the current and numerous back issues, all illegal. We flaunted smoking marijuana from opening at 10:00am to closing at 9:0opm every day in the store. We invited our customers to partake with us.

We were an instant sensation. We started selling seeds three months later, and we began producing the "Marijuana & Hemp Newsletter" magazine immediately, which eventually became Cannabis Culture. In issue #3 we produced the most popular article ever to be printed in all of the 79 issues of that magazine (five as Marijuana & Hemp Newsletter, twelve as Cannabis Canada, 62 as Cannabis Culture, all from 1994-2009), "How to Open Your Own Hemp Store – And Start a Revolution in your Community!" in the summer of 1995 (see the updated version from 2006 here and see the original article here). Within a year of that article, over 30 "hemp stores" were opened across Canada, some remain in business to this day, such as Toronto Hemp Company, and Hemp Ware in St. John's.

Vancouver 420 in 2004Within days of opening, I became aware of a peculiar daily phenomenon I had never experienced as a pot smoker in my hometown London, Ontario. From December 21, 1980, the day I first smoked pot, to July 2, 1992, when I moved to Asia to live for 20 months, I had never heard anyone yell out "Four Twenty".

I arrived in Vancouver on March 1, 1994, completely new to the west coast and Vancouver, and in May I met Ian Hunter. On a few occasions I had heard him say, "It's 4:20, everyone," to any nearby, and he'd light up a joint. I thought, "what strange creatures these west-coasters be!" Ian was a known hempster hipster in Vancouver. Later he would open the still-operating Sacred Herb in January, 1995. Ian died in a nighttime boating accident in 1999 after smoking DMT by himself in a small boat, falling out of the easily-rocked vessel, and drowning. Ian died way too young, but I was told he washed upon the shore with a beatific smile upon his face.

Ian explained the 4:20 daily ritual to me, but I didn't think much of it at first. However, when I hired the dread-Deadheaded Danna Rozek to be the store manager in August 1994, she hired fellow Deadhead Cindy Lassu, and with Ian they became the nucleus of the HEMP BC store staff. We smoked pot in the store non-stop. At 4:20, all three would yell, "Four-twenty, smoke 'em if you got 'em!" – which seemed redundant to me, since we were always smoking anyway, but it became a fun loud exclamation every day. I got used to that afternoon celebration, and I noticed that most customers to our store were unfamiliar with it, but it quickly became popular in our limited circle of customers and within the small but growing culture we were part of.

One day in early March 1995, Danna and Cindy came to me at my desk at HEMP BC, and we had this exchange I remember vividly. Danna said, "Marc, we'd like to have a 'Four-Twenty' celebration on April 20. We'd like your permission and approval to put on a Four-Twenty concert and rally and fun time in Victory Square next door."

Victory Square – which we were calling “Hemp-For-Victory Square” (named after the re-discovered 1942 US Department of Agriculture film "Hemp for Victory" that Jack Herer had found after years of the US government denying its existence), and at that time a staple in the nascent hemp and legalization movement – was a park fifty feet down the street from HEMP BC, at the southwest corner of Cambie Street and West Hastings.

Vancouver 420 in 2008"What do you mean? A rally at 4:20 that day, on April 20?" I asked in clarification.

"No, an all-day celebration of Four-Twenty, on Four-Twenty, because April 20 is like, Four-Twenty, get it?" Danna further explained, though I had 'gotten' it.

"You mean, hold a celebration, a party, rally, good time in the park, all day on April 20?!" I was aghast. "Could we get away with that?"

"Yeah, that’s exactly what we mean," said Danna, representing her and Cindy. "I'm sure we could get away with it. We could try anyway. I'm sure it'll work."

As I come from an Ayn Rand capitalist-hardwork-ethos background (since October 1979), this idea that we'd enshrine a whole day of celebrating cannabis by smoking pot for several hours in a public square seemed outrageous, outlandish, and playing into the slacker-stoner stereotype. "No, we can't do that." I said.

"Yes, we could!" Danna and Cindy immediately responded with a very enthusiastic emphasis.

"No, I can't condone that." I reiterated.

Thirty minutes later the two came back to my desk as I was working. "Even if you don't approve, can we go ahead and do it anyway?" they implored.

I had always believed in taking initiative, and admired self-starters. I considered them for a few moments, and said, "Yes."

They both jumped up and down and embraced each other and cried "Yay!!!", and then they immediately asked, "If we organize it, will you help?"

"What does that mean?" I asked.

"Well, we drew up a budget and we'll need $200, and electrical cables from the store here to the square to provide power for the amplification system, and we'll need to work at the park most of the day, so will you help in those things and whatever else might come up?"

I remember how these two very hippie-like young women were making me part of their 4/20 conspiracy. I used to sit at my desk, puffing pot, wearing white business shirts with a tie and vest, akin to an older Alex Keaton (played by Michael J. Fox) from Family Ties, with John Lennon glasses at the time.

"Yes. Put your plan together. Tell the rest of the staff," (by then 8 people) "and we'll make sure it happens." Again, Danna Rozek and Cindy jumped up and down embraced and cheered.

Marc speaks at Vancouver 420 in 2009So April 20, 1995 came around. It was a beautiful sunny day. Thick cables ran from every electrical outlet at HEMP BC out the front door and east on Hastings for about 70 feet (and across cobble-stoned Hamilton Street) into Victory Square park, where a stage was erected, musicians retained, speakers invited, even some vending booths set up. A banner over the stage welcomed the people "4/20 Day in Vancouver".

The proceedings started at noon with about 50 people watching and tentatively smoking. By 2:00pm there were 150 there, many now sitting on blankets and sheets on the ground, more people comfortably ensconced for the afternoon, and a subtle waft of cannabis floating in the air. So far, no police were visible, and a certain comfort set it. At the peak at about 4:00pm, there were about 250 curious people watching the musical entertainers and a different speaker exhorting the benefits of cannabis every 15 to 30 minutes. It went to 7:00pm when the daylight faded, and at no point did any police come by, even though Victory Square park is at a main intersection, the very busy Cambie and Hastings streets. The day was a total success. No one was arrested, everyone had fun – a tradition in Vancouver had begun.

One of the speakers at this first public April 20 gathering was then-editor of Cannabis Culture (then Cannabis Canada) magazine, Dana Larsen, who has continued to be a major activist in Canada. He is currently coordinating the campaign www.SensibleBC.ca, which seeks to have a referendum placed before the voters of British Columbia to decriminalize marijuana possession. I was also one of the original speakers, along with Ian Hunter, Rev. Leroy Campbell, and Danna Rozek.

The following year, in 1996, the Vancouver 4/20 was again organized by HEMP BC staff and I at Victory Square, and the park was largely occupied to capacity with over 500 people there at its peak, with a much greater concentration of cannabis smoking going on. In 1997, we decided to move the celebration to the plaza at the Vancouver Art Gallery in downtown Vancouver's business and shopping district, where it has continued to expand its size, attendance and smoking hours each year.

Vancouver 420 in 2010In 1997, a thousand people attended, and it remaining about 1,000-1,500 people at its peak at 4:20 each year until about 2004, when it hit 3,000. Then it hit 5,000 people in 2005, and it was a noticeable increase. Traffic on the main corridor West Georgia Street was blockaded by police. YouTube’s introduction and the ability to share videos online popularized the April 20 smokeout rally idea on the internet, which began to inspire other cities around the world to organize their own April 20 events.

By 2008, about 8,000 people crowded the plaza by 4:20, and Howe Street and Georgia Street were sealed off by the City. In 2010, it is possible 10,000 people attended at the peak. People are present from sunrise to after sunset. And on April 20 last year, there were 20,000 people packed onto and around the Vancouver Art Gallery grounds at 4:20pm.

An open farmer's market has been very much a part of the celebration since 2004, and now it is the most remarkable phenomenon you can see anywhere, with dozens of cannabis vendors selling – showcasing! – cannabis wares of every sort. The smoking starts now at about 8:00am and continues to about 8:00pm. After 4:00, when the activist community organizers on the now-huge stage coordinate the joint toss and count down to 4:20 pm, the resulting cloud from 20,000+ people all smoking joints and bongs simultaneously and then exhaling is nothing short of awe-inspiring. See these videos from previous years to see what I mean, at www.420Vancouver.com.

The tradition that started in Vancouver has, through YouTube and the internet, spread to every place on earth where there are pot smokers, and we are everywhere! This year's 4/20 promises to be easily the largest attended worldwide cannabis celebration in the history of mankind, especially as it falls on a Saturday. Most major cities in Canada have a 4/20 in a public square or major park this year (see the list and add your town at www.420rally.ca). Some will be huge, like Toronto and Vancouver, with stages, scheduled entertainment, vendors, and pot smoking rampant in the entire daylight hours.

This year, Canadian cannabis activist and lottery-winner Bob Erb contributed upwards of $100,000 to assist the organizers across Canada in putting together the most awesome national 4/20 celebration ever mounted. So there are sophisticated 4/20 celebrations in every province and territory in Canada this year, even in Yellowknife in the North West Territory! Ontario has major 4/20 celebrations in London, Windsor, Hamilton, Ottawa, Sudbury, and Toronto. See more information at www.420rally.ca.

Vancouver 420 in 2012April 20 celebrations will go on in major cities in Australia, through all the United States, and in parts of Europe and South America. Many universities and colleges in the world have a 4/20 celebration somewhere on campus that day. The internet has helped the phenomenon of 4/20 become an inspiration to every pot smoker, an opportunity to celebrate our culture.

Following on the 4/20 celebrations, another worldwide event that I sponsored in its infancy from 1998 to 2005, with about $30,000 per year in contributions, was the Global Marijuana March, originally called the Million Man Marijuana March (or Million Marijuana March). The GMM was started by Dana Beal, an activist from New York City whose activities hailed as far back as the early 1970's in the Abbie Hoffman Yippies (Youth International Party). Dana Beal and I both did pioneering work in ibogaine drug addiction rehabilitation work, and Dana established the Global Marijuana March in 1997 and brought me (and High Times Magazine) on board in 1998 to promote it.

The Global Marijuana March has less pot, and more protest and politics. In the United States, 750,000 people are convicted each year for marijuana offenses, and over 22 million Americans alive today have criminal records for marijuana convictions going as far back as 1966. Statistically, 26 million Americans have received criminal records for marijuana convictions since 1966, but four million of those convicted are no longer living.

More political in orientation than the April 20 4/20 celebrations, the Global Marijuana March is a protest march through major cities from a point A to point B. In Canada, the largest of these has been the GMM in Toronto, with over 30,000 participating in recent years. This year, in most places in North America, the GMM is on Saturday May 4, as it is in Vancouver this year. The City of Toronto has this year, for the first time, given permits to both the April 20 gathering at Yonge Street and Dundas Square, and the Toronto Freedom Festival/Global Marijuana March – though this year, the GMM got its approval for Saturday, May 11. Find more information at www.GlobalMarijuanaMarch.ca and www.TorontoFreedomFestival.com

Both events are important in consolidating our presence as a relevant cultural and political force. April 20 is such an eye-opening cultural phenomena throughout the world that all major international, national, regional and local media now cover every aspect of the 4/20 tradition.

From 1995 to 2013, in the space of 18 years (running parallel to the introduction of the “World Wide Web” in September 1994), the 4/20 phenomena has grown exponentially so that as many as ten million people will gather in public places throughout the world to celebrate cannabis by smoking marijuana, despite the prohibition in every jurisdiction on the planet (except the states of Washington and Colorado in the USA). It is expected over 200,000 Canadian cannabis consumers will participate this year, and between one million to two million Americans take part.

Marc, prison music, MRSA infections, and more.

submitted by on March 10, 2013

Marc and Jodie, Yazoo prisonToday is Sunday, March 10. I've 486 days to go, 1,104 days done, now over 3 years done on this sentence. My Canadian transfer paperwork has arrived in Ottawa and my US transfer paperwork goes to Washington, Dc on April 8, the required two years after I was rejected for transfer to Canada by the US Department of Justice on April 6, 2011.

I'm hoping that if my transfer application is accepted (say, by June 10 in Washington, July 20 in Ottawa), I'll be back in the Canadian prison system in September and free at home by next January. Otherwise I'm in the US prison system until July of next year.

The 'We The People' website at WhiteHouse.gov now requires 100,000 signatures in 30 days for any petition to get an official response from the White House. Their responses thus far to any petitions have been very superficial and inadequate. Last year, when a petition urging a pardon for me exceeded the then-threshold of 5,000 signatures, the White House response was worse than negligible – it was insulting, a “No Comment” statement.

Then the level was raised to 25,000, and many petitions urging the federal government to legalize marijuana, or reschedule it from schedule 1 to 2, etc. met the threshold – and as a cynic would expect, all received canned propaganda repudiations from drug czar Gil Kerlikowski. If only US citizens would have rallied around Ron Paul as a presidential choice, how different the official White House response for legal marijuana would be!

So I won't be encouraging a petition drive to 'We The People' regarding my transfer, though in January I thought that would be a good idea. What I really need my American friends to do is write their US representatives and Senators requesting a letter to the Department Of Justice endorsing my transfer back to the Canadian prison system. The person to contact is listed here; and my previous blog has more info, here.

My band Yazoo performed our 12th concert in freezing-cold 5 degrees Celsius temperatures outside on the evening of Saturday, February 16th (Presidents Day concert). Though it was cold (I was wearing a t-shirt, two thermal undershirts, a shirt, my winter coat, a wool hat, and wool gloves when I wasn't playing – I was nice n' toasty in all that) and our audience small, it was our best performance as a band, and my best performance individually. We had a great time. Our set list was:

1) Hey Joe (Hendrix)
2) Boys are Back in Town (Thin Lizzy)
3) Running Down a Dream (Tom Petty)
4) Jumping Jack Flash (Rolling Stones)
5) Black Magic Woman (Santana)
6) Plush (Stone Temple Pilots)
7) Pride & Joy (Stevie Ray Vaughan)
8) Red House (Jimi Hendrix)
9) Whole Lotta Love (Led Zeppelin)
10) Green River (Credence Clearwater Revival)
11) Kryptonite (3 Doors Down)
12) Purple Haze (Jimi Hendrix)
13) Little Wing (Steve Ray Vaughan)
14) Sweet Home Alabama (Lynyrd Skynyrd)
15) Blue on Black (Kenny Wayne Shepherd)
16) White Room (Cream)
17) Voodoo Child (Hendrix)

I am pleased to say I made virtually no mistakes performing (which I can rarely boast) and the tone on the Carvin bass was perfect.

Marc Emery bass guitarAs you can see, I was able to get some photographs done here at Yazoo with me holding the Carvin bass I play in the band. There are a few photos with Terry my best buddy and bandmate on lead guitar. My 13th concert is next weekend (March 16), and we'll be adding songs Blues Deluxe (Joe Bonnamesa), The Last Resort (by Papa Roach) and bringing back Texas Flood by Stevie Ray Vaughan, Stormy Monday, Heartbreaker/Living Loving Maid (Led Zeppelin) and a few others from the vault. Ten photos of the band performing Red House and Green River in the rehearsal room are on their way to Jodie and will appear soon on Facebook. They will be made into a poster with a band photo and individual performance shots. "The greatest rock band the free world has Never heard… YAZOO" will be at the top of the poster.

Last Friday I wrote Jodie an email about my friend and previous cellie Daniel having a massive bacterial infection in his whole lower right leg. On Tuesday, a boil appeared on his leg, his third in two months since he had a surgery here for a hernia. He squeezed it, which is dangerous to do. I know, as I contracted a massive infection on my left butt cheek when I was at D Ray James for-profit private prison in Georgia (prior to being sent here) and had a quarter sized hole in my cheek leaking pus and blood for two weeks after a week of intense swelling and inflammation in the area. Fortunately, the infection was not near any vital organs, which is when a MRSA infection is particularly dangerous. MRSA is a kind of aggressive 'staph' infection that starts very innocuously and rapidly spreads. Most modern antibiotics are no longer effective in defeating the infection. MRSA (stands for 'Methicillin-Resistant Staphylococcus Aureus') infections require immediate and aggressive treatment of still-effective antibiotics, or a person can get gangrene and lose limbs, have vital organs shut down, and even die. The creator of The Muppets, Frank Oz, died from a massive infection that could not be treated in time, for example.

In prison here I read a very good novel about how antibiotics went from theory (pre-1929) to fact when Dr. Alexander Fleming discovered antibiotics in the late 1920s. He found that moulds cultivated on stale bread seemed to attack bacteria. But it was not possible for the next ten years to efficiently produce enough antibiotics to even save one person. Our generation has no experience with the kind of mortality that used to occur when people before 1943 got a bacterial infection, whether it was venereal disease, staph infections, and others. Healthy people could scrape their knee on Wednesday and be dead in hospital by Monday in the times before 1945, there was no effective cure for most infections. The book is called “A Brilliant Radiance” by the novelist Lauren Belfer (I also highly recommend her other novel about the first massive hydro-electric project, at Niagara Falls, providing power for the city of Buffalo, called “City of Light”). A Brilliant Radiance showed how a massive effort by the pharmaceutical industries and the US War Department made finding a way to mass produce antibiotics a priority of the war effort. It was so successful that in the five years from 1940 to 1945, antibiotics went from being the rarest of any medical resource to staggering abundance, such that antibiotics were sold for pennies a pill only five years later.

Antibiotics have cured the industrialized world of cholera, meningitis, tuberculosis, dysentery, E-coli, and dozens of other previously fatal bacterial infections. Antibiotics might be the greatest medical development in the history of mankind. But now, due to excessive and wasteful use, the bacteria are adapting, such that what are called methicillin-based antibiotics no longer work on a range of staphylococcus-type infections. And 'staph' bacteria is a plentiful presence on all skin surfaces and found everywhere in ordinary daily circumstances.

Last Tuesday night, Daniel had his third boil in two months on his right leg. Recurring boils on the body are a sign of MRSA, the boils come from festering infection in the body, but are not yet near major arteries or organs. He showed me his leg, and to me, this third boil was clearly indicative of MRSA, as the area around the boil was inflamed. His previous two boils, though open and weeping, had gone away with antibiotic ointment. He had hernia surgery two months ago, and it was obvious to me he picked up MRSA during the surgery. I told him to go see medical. They gave him Clindomycin, an antibiotic that may or may not be effective against MRSA. By Friday the whole leg was red with inflammation, the boil was weeping significant pus, and all the leg was swollen from the knee to the ankle.

I told Daniel the infection was spreading and getting more substantial and had to go to medical and insist they give him Bacterum, an effective antibiotic (used on me when I had my major MRSA infection in February 2011). I warned him that within days if the infection overwhelmed his leg, he could get gangrene and lose his leg to amputation, or worse. This made him feel very uneasy, of course. He went back to medical at 1:00pm. After looking at it, they said yes, it looks serious, but the earliest a doctor could see him was Monday. When he complained to his counselor, the counselor replied, "If you don't see a doctor by next Wednesday," (in five days!) "come back and tell me." I told Daniel if he had to wait until Monday, he'd likely lose his leg, the infection was so obviously serious.

Then I wrote Jodie my concerns regarding Daniels extremely perilous health situation and she posted about it on Facebook, reaching tens of thousands of people who were quite concerned too. At 3:30pm an unusual call came to our unit from medical, requesting Daniel come to medical immediately. There was a doctor, the chief medical administrator, and the head nurse to examine him. They prescribed him Bacterum, and said the surgeon who performed the surgery would be here to see him Monday. His leg continued to be inflamed and swollen over the weekend. On Monday he was hospitalized, and 48 hours later, he was still there. I was grateful the medical department took the infection seriously, but I don't know how Daniel is faring.

The worst fear any prisoner has in captivity is having a life-threatening medical emergency essentially around strangers (fellow inmates) and with largely ambivalent (and way overworked) medical staff. It’s at a time like that you want a loved one or someone who actually cares for you to be nearby. The thought of dying essentially alone among strangers who probably care not a wit for you is disconcerting. When an inmate gets hospitalized, they are shackled all the way to hospital, and to the bed at all times, which is humiliating, of course. Hopefully Daniel will return from the hospital fine.

[Update from the 28th: Daniel just got back, he looks glad to be alive and well, he very effusively thanked me. He was hospitalized for 72 hours and given antibiotics intravenously over that time, and was released back in to the custody of Yazoo here, on the mend and out of danger! I'm grateful for that. He was on two IV drips, one nutrition, the other antibiotic, the whole time. He leg is greatly recovered.]

The US federal government cuts in federal department budgets has me worried that life here will be worsened. All the C.O.'s (correctional officers) and staff here are going to be required to take a day off without pay (furloughed) every two weeks. I'm also concerned that the money spent on food will be cut back to make our meals even more dubious.

All the money spent on music equipment, pool tables, televisions, cable TV programming, arts and crafts, the leatherwork shop, sports and exercise equipment, all inmate activities of every kind (except education) are paid for by inmate trust funds. The taxpayer doesn't pay for anything to do with my band Yazoo, our equipment, or any of the recreation equipment like exercise bicycles, poll tables, basketballs, etc. So that is not affected by any federal government cutbacks. The 1,700 inmates here spend approximately $150,000 a month in the commissary (inmate store for hygiene items, extra food, etc.) so about $45,000 a month of those sales (items are all costs plus 30%, which then goes to the inmate trust funds) goes to pay for everything the inmates do on the rec yard, in the rec hall, all TVs and TV programming in the unit day rooms.

In addition to a reduction in staff starting Friday, the airports will have fewer people working from the Transportation Safety Authority (TSA) and air traffic controllers, meaning Jodie's flights to see me will likely go through delays. And there will be fewer staff here at the prison, so I'm concerned visitation processing will be slower. Yesterday and today all prisoners have been locked in our units, and not allowed outside. And it’s a gorgeous day outside today. There is no explanation why. [Note from Jodie: The US federal government announced that prison lockdowns may become more common simply to deal with the spending cuts, but this lockdown was likely the result of a prison employee being killed in another state, which results in lockdowns at all federal facilities.]

I slept terribly the other night because being cooped up, all I do is read and do crosswords, but that is not enough to make me tired enough to have a good sleep. I've always been a difficult sleeper, most of my life not getting tired until 4:00 or 5:00am, and often shaking my legs violently. But a month ago I started a personal program of not eating anything after 5:30pm – I mean nothing at all, drinking only water and absolutely no coffee or tea, and I never drink sodas. That's been working very well. I'm sleeping well if I go to bed on an emptier stomach feeling somewhat hungry (hard to resist the urge to eat something). That will be a hard discipline to maintain when I'm in the free world at home. Smoking pot always stimulates appetite and so I typically ate things in the evening and late at night. Plus it stimulates other desires and wants. What cannabis has never done is make me sleepy. So I didn't really ever get tired until 5:00 or 6:00am in the morning, I'd sleep till 10:30 or 11:00am and get up.

I've sent thank you cards to the three Americans who sent me the four issues of the Sports Illustrated swimsuit edition. They are circulating widely in our 120-man unit. And thanks to Dana Larsen for putting a book wish list for me at amazon.com where anyone can send me a book off that wish list. Already I've received ten books off the wish list, some graphic novels, Rex Stout mysteries, Ann Rule true crime stories, guitar tab music books. I'll send a note out to anyone who sends me any book via the amazon wish list, but receipts don't have the name or address of the payee, so feel free to tell Dana or mail me a note saying you sent me a book. In the last three weeks I've sent out 50 cards (with wee small lettering to get as much in there as possible), trying to catch up on my correspondence, on one side is a photo of me in prison, or a photo of Jodie and I in the visitation room here, and the other side is blank, and I found I can get four or five of those done every day in about two hours.

Jodie Emery for Vancouver-West EndMy wonderful wife Jodie is again running for a seat in the British Columbia Legislature. The provincial election is on Tuesday, May 14. Jodie needs money to run her campaign, and any individual or corporation in the world can donate any amount to her campaign. All British Columbia residents who donate between April 15 and May 14 get a tax-creditable receipt; a portion of your donation (if you are a BC resident) is good for a refund off your BC provincial income tax. All others can donate anytime from now to May 14, and in any amount, and you'll get an official receipt, but it’s not tax-creditable in your jurisdiction. Jodie needs to raise $5,000 to $15,000 to do phone electioneering, pay for signs, literature, and advertising. Make checks and money orders to "The Campaign to Elect Jodie Emery" (you must include your name and address along with donation) and send to: The Campaign to Elect Jodie Emery, 307 West Hastings St., Vancouver, BC, Canada V6B 1H6. PayPal donations can be sent to jodie.emery@greenparty.bc.ca and more information about donations can be found on her website www.JodieForMLA.ca

On that final note, be sure to support Dana Larsen's extraordinary Sensible BC campaign to put decriminalization to the voters of British Columbia with a ballot initiative signature drive. It’s at www.SensibleBC.ca. Jodie's BCMP vapor lounge is donating 50% of proceeds from Tuesday’s open mic jam nights to the Sensible BC campaign. Dana also has a patron (Bob Erb, the marijuana activist winner of a $25 million lottery and a former BC Marijuana Party candidate) who is matching all contributions dollar for dollar, so please contribute money to the Sensible BC decriminalization ballot initiative drive to keep the anti-prohibition conversation going strong.

Marc Emery’s Application to Help Grow Washington’s Legal Pot

submitted by on February 25, 2013

Marc Emery cannabis plantUpon learning that the Washington State Liquor Control Board is seeking consultant applications for a legal marijuana production and distribution system, Marc wrote this tongue-in-cheek submission. Marc was extradited to and sentenced in Seattle, Washington despite operating his seed business in Vancouver, BC, Canada at all times.

Dear Sirs and Madams of the Washington State Liquor Control Board,

Please consider my bid, or rather, application for consideration, to be a consultant in one of the four fields of marijuana expertise required by the WSLCB:

1) Product and Industry Knowledge
2) Product Quality Standards & Testing
3) Product Usage and Consumption Validation
4) Product Regulation

I understand your need to meet the voter endorsed deadline of December 2013, whereby retail offering of cannabis products are expected to be found in the current WSLCB outlets. I offer strong skills in marketing, cultivation, genetics, breeding, retail, business, working with large groups of co-workers, but my only caveat is that I am currently a guest of the US federal prison system for my peaceful and successful involvement with servicing the needs of well over 3,000 citizens of Washington state in cultivating marijuana from 1995 to 2005 (as well as millions of others throughout the United States). I do expect to be released from this inconvenient situation and repatriated back to Canada in December of this year. Perhaps you can use my resume as back-up if one of the other applicants turns to be unsuitable when you can see their capabilities (or lack thereof) at close range.

My name is Marc Emery. I am one of the world's most recognized brand names in what I am proud to say is the worldwide cannabis culture. My name is a cachet of integrity and quality among the marijuana connoisseurs, enthusiasts, cognoscenti and consumers the world over – and certainly in Washington State, to which I supplied an extraordinary range of quality genetics to thousands of citizens, including medical, commercial, household gardens, from 1995 to 2005. The Washington state District Attorney's office in their prosecution contended I was responsible for the cultivation of three million cannabis plants across the United States, through my seed sales done via postal delivery from my home Vancouver, BC, Canada.

I have been given privileged and rare access to over 300 indoor marijuana gardening projects, and over 50 outdoor and greenhouse projects, in the years from 1990 to 2009, largely as publisher and editor of 75 issues of Cannabis Culture Magazine, which I was responsible for from 1994 to 2009. In that capacity I was given enough access to these horticultural enterprises to describe them in detail in my publication. I have an understanding of horticultural techniques of every kind, including esoteric methods like swamp growing, tree-top growing, underground growing, brewery conversions, off-shore barge growing, subterranean rail-car growing, bio-dynamic growing, among others, but certainly most of my experience is in commercial mass production operations using hydroponic, soil or soilless media. I am very familiar with large conventional grow theatres using 50 to 150 thousand-watt (HPS or Metal Halide) bulbs. In my experience, typical production is 1 to 1.2 pounds (dry weight) per 1,000-watt light bulb per 60 days.

Marc Emery cannabis plants

I have supervised the breeding of 20 individual genetic varieties of cannabis as part of the largest cannabis seed distribution project the modern world has ever seen, having as many as 380 varietals of cannabis in my seed distribution catalog at the peak of my efforts.

As editor of Cannabis Culture magazine from 2004 to 2009, I edited manuscripts by horticulturalists, medical experts, scientists, historians, for the digestion of our reading audience. All 74 issues of my highly regarded magazine are online at cannabisculture.com/backissues for your review.

I have been a successful retailer since 1971, and have always employed between 20-45 people from 1996 to 2009 (when my spouse took over the reins of the business), so I am used to working harmoniously with numerous co-workers. From 1995 to July 29, 2005, when the untimely interruption by the Drug Enforcement Administration occurred, I was likely the world's largest seed distribution business, and uniquely, the only such cannabis seed distributor identified by having the proprietor's name (mine) clearly identified at all times and known to use the seed revenue to finance political activism and drug policy reform. While this no doubt contributed some incentive for my adversaries to arrest me, it also made my name a valuable brand attached to an outstanding performance record amongst the very people you will be appealing to in the Washington state marketplace. I assure you having the Emery brand integrated into your production and marketing and product development will ensure a credibility few other applicants can provide.

As I look at your situation, I understand that about 300,000 Washington state residents will be regular consumers of about one ounce a month, with up to one million tourists annually who will take advantage of Washington state's new cultural zeitgeist. This requires a retail distribution paradigm that favors variety and price breaks at all levels. I foresee demand levels of about 500,000 to 600,000 ounces (dry weight) per month required. At 16 ounces per pound this is a requirement of 37,500 pounds per month, and since a grow-cycle is about 60 days, 75,000 pounds dry weight every 60 days would need to be produced to meet the expected requirements of the marketplace. Once economy of scale, start-up cost inputs are calculated, I expect the cost of producing the cannabis will be $10-$20 an ounce, or less, but not more, and this would include all production and distribution as well as capital inputs pro-rated over three years, ultimately reducing the costs after three years. Of course, taxation would need to be applied as per your regulations.

This would mean 75,000 1,000-watt bulbs of production operating in the state of Washington under the aegis of the WSLCB to meet this demand. With the retail price at $20-$40 an ounce plus taxation, this will wipe out all aspects of the black market in Washington state, certainly the voters had this in mind when they passed Initiative I-502. This will also make impractical any need to for medical users to grow their medicine, as long as taxation is not so onerous as to re-ignite black market production.

Marc Emery plant photo by Jeff V

An ideal production facility with 150 1,000-watt bulbs, with concrete foundations and all sophisticated equipment necessary for 165 pounds every 60 days, (functionally, it would be 35-40 pounds every 15 days), costs $1,000,000 to $1,200,000. To meet the 75,000 pounds every 2 months, you'll need 200-350 facilities to be built. You could make vast-sized facilities of 500 (or even 1,000) bulbs, but the cost savings are inversely proportional to increasing risks, as plant diseases, or pest infestations and other unforeseen disasters, in a closed environment, are difficult to extinguish once endemic in one facility. It is better to have 200-350 separate facilities than 10-20 staggeringly large facilities, so production problems in one unit do adversely affect the production volumes required. Sophisticated outdoor greenhouses are also a cost-efficient consideration but this would be something better suited to eastern Washington's more reliable sunny weather. There is also a market for sun-grown outdoor field marijuana that will have far smaller start-up input costs, but will require a modest level of security.

In all three of these kinds of horticultural endeavors, it is vitally important that all efforts be documented, and under regular review, and I am very familiar with this necessity.

I work well with government bureaucracy, scientists, medical researchers, legislators, policy makers, horticulturalists/farmers (and they can be an iconoclastic, dare I say, eccentric lot, believe you me), retailers, and marketing departments. I understand product promotion in this field very well, and I certainly know well the various client bases being served. I can provide endorsements and bona-fides for all these claims upon request should you be interested in considering me becoming a member of your team.

I do hope my Canadian citizenship and my current status as prohibited-from-entering-the-United States-for-life is not a too-extraordinary impediment to the successful execution of this job. I'd like to point out it wasn't particularly my involvement in cannabis cultivation that made me a US federal prisoner and felon, though the official conviction is one count of conspiracy to cultivate marijuana. It was in fact my political advocacy to legalize marijuana and the millions of dollars I contributed to US organizations and individuals to accomplish this objective via ballot initiatives and various court, legal and political actions that brought me to the attention of the DEA (see among my bona-fides, a press release from DEA chief Karen Tandy from July 29, 2005).

However, my grassroots reputation with the people who did, after all, vote in this now legal regime in Washington state, is at its all-time zenith. This can only be of considerable benefit to the WSLCB should I join your team and apply my skills and name to your efforts to supply the people of Washington with the finest cannabis possible. My original prosecutor, former Western Washington District attorney John McKay, had a considerable involvement with Initiative 502, and in view of his stark conversion-on-the-road-to-Damascus change of heart regarding marijuana prohibition, I do expect an excellent review from him should you consult him in this matter, and hope in this new enlightened post-502 era, my credentials will be weighed fairly viz. a viz. the other applicants.

Marc and Jodie Emery, December 2, 2012Regrettably, at this time, being a guest of the US Bureau of Prisons in Mississippi, I cannot appear for an interview in person in Washington, but I think it would still be very profitable for the WSLCB to come to Yazoo City medium security federal prison on any Friday evening, Saturday or Sunday to conduct an interview with me here. Considering the likely investment of approximately $200,000,000 in facilities to produce the marijuana, and the more than one billion dollars in sales annually that are to be expected, the costs of having your representatives interview me here at Yazoo would be an extremely wise and prudent investment.

In anticipation of a successful meeting for one of your consulting positions,
I remain (until July 9, 2014)

Marc Emery Begins His Campaign to Come Home

submitted by on January 24, 2013

Marc and Jodie Emery, December 1, 2012Last week I filled out my paperwork for the Canadian government regarding my desire to be transferred to the Canadian prison system. In March I will fill in the US paperwork to have it in Washington, DC by approximately April 6th, two years to the day after the US Department of Justice rejected my first application.

If I don't get accepted for a transfer by either the US or Canadian governments, I will be released on July 9th, 2014 here in the United States, spending 15-20 days at a US Immigration & Customs Enforcement facility (likely in Oakdale, Louisiana), and then flown to either Vancouver or Toronto. I'd like to think that, at the latest, I'd be home with Jodie for our 8th wedding anniversary on July 23rd, 2014.

However, if I get approved for transfer under the Canada-US treaty (International Transfer of Offenders Act), I could be en route to a Canadian federal prison in the summer of this year. If I arrive at a Canadian prison on September 1st this year, under new rules enacted by the Conservative government, I’ll be held for a while before being released on December 10th, 2013 – just in time for Christmas.

If I were originally sentenced in Canada, I would have been automatically released July 4th, 2013, at 2/3 of my sentence; that was the statutory release date for any federal prisoner. But under punitive new rules by the Harper government, I will, upon arrival at a Canadian federal prison, have to spend 1/3 of my remaining US sentence in a Canadian prison, even though it goes beyond the statutory release date for any other prisoner.

So whereas I should be released in Canada on July 10th this year (having served 40 months of a 60 month sentence that day, the Canadian release time for any other Canadian federal prisoner) if I am brought back and arrive on September 1st (an estimate, as it takes up to three months after the Canadian government approval to wend my way back through the US system into a Canadian prison), instead of being automatically released, I have to serve an additional 1/3 (of the sentence up to the July 9th, 2014 US release date). That's 1/3 of 317 days, or 106 extra days past September 1st, which would be December 11th, 2013.

Marc and Jodie Emery, December 2, 2012

But at least I would out before Christmas this year, and home almost 7 months earlier than my US release, so it's still a benefit.

Here's how the treaty application system works, and how I very much need the help of everyone who thinks I deserve their help – hopefully, that's you and any other members of the cannabis culture you can talk to in person, on Facebook, in other social media, at school, at work, at your local medical pot club, vapor lounge, and your friends and your family.

Since I'm a Canadian citizen who lived in Canada before my incarceration, and I'm not affiliated with organized crime, or a threat to the safety of any Canadian, I qualify to be repatriated into the Canadian system. Once I file my Canadian paperwork, they process it and send someone from Corrections Canada to see Jodie, check out our apartment where I'm going to live, and ask a lot of personal questions.

The decision by the Canadian government to accept or reject my application will be made after the US Department of Justice (DOJ) makes their decision, which will be 6-8 weeks after my US application is received in Washington, DC.

My application will go to the DOJ in Washington by the second week of April, and I should have an answer back by the end of May. If approved, this information is sent to the Canadian embassy in Washington, and then is forwarded to the Canadian Minister of Public Safety – currently the Honorable Vic Toews – and he can accept, reject, or stall.

I fully qualify by the criteria set out by both the US and Canadian federal governments regarding treaty transfer approval. But that does not mean approval is automatic; governments often do ignore their own criteria, so as much political pressure as can be applied needs to be leveraged.

THE CAMPAIGN, AND WHAT YOU CAN DO

US flag

For My American Supporters:

I need you to contact your Congressmen (your US Rep in the House and US Senator – click here to find yours) or other sympathetic elected officials urging them to write a letter (or add their name to an existing letter that Jodie will soon provide on www.FreeMarc.ca) endorsing my transfer back to the Canadian penal system. You are asking them to write to the International Transfer of Offenders program director:

Paula A. Wolff, Chief
U.S. Department of Justice, Criminal Division
OEO, International Prisoner Transfer Program
JCK Building, 10th Floor
Washington, DC
20530

You should point out that I am a non-violent cannabis offender who was convicted in Washington state of selling seeds from my desk in Vancouver, Canada. (You can also cite any of the other important details about what I did and why, which are listed under the "Who is Marc Emery" page at www.FreeMarc.ca) You can say I have had an exemplary career despite this one federal conviction. You can say I have served over 3 years of a 5 year sentence already, and am due for release in July 2014 even without a transfer. I have had no incidents of any kind in over three years of prison, so I am considered a model prisoner. I am not asking for a commutation or pardon, merely a transfer back to Canada under the current US-Canada prisoner exchange treaty.

Copies of any letters by elected officials should be forwarded to Jodie (her email address is JodieEmery[at]gmail.com), who will then forward these to my transfer lawyer in Washington, DC, who makes a pitch to the DOJ on my behalf sometime in April or May. I am hopeful the original prosecutor in my case, former Western Washington US District Attorney John McKay will write a letter endorsing my transfer, particularly in light of his sponsorship and advocacy in the campaign to legalize marijuana with the I-502 initiative that was successful in November, and which Jodie and I were official endorsers of.

In mid-February, Jodie and CannabisCulture.com (and FreeMarc.ca) will begin a campaign to make my supporters aware of an impending petition drive to be put on the US government website "WE THE PEOPLE", similar to the one in 2011 asking for me to be pardoned, which the White House was forced to respond to (but weaseled out of with a “no comment” answer).

On March 15th the "We the People" website will have a petition titled "TRANSFER US FEDERAL PRISONER MARC EMERY BACK HOME TO CANADA". The petition will ask the President to direct his Attorney-General Eric Holder to direct the administrator of the International Transfer of Offenders division of the DOJ to approve my transfer application. We have 30 days (March 15th – April 14th) to gather 25,000 signatures/names so that it meets the threshold for President Obama's office to acknowledge it.

Canadian flagFor My Canadian Supporters:

The Canadian campaign to repatriate me to the Canadian system kicks into high gear once the US Department of Justice approves my transfer application at their end, in Washington, DC. That is expected to be by the end of May, early June.

By April, I need all my Canadian supporters to write their Member of Parliament (find yours by clicking here) and any other elected local or provincial representatives, seeking them to write a letter to urge the Public Safety Minister to accept my transfer application immediately upon acceptance by the US Department of Justice. The Minister of Public Safety Canada can be contacted via email or by regular post.

(Postage not required)
Minister of Public Safety
House of Commons
Ottawa, Canada
K1A 0A6

We should be able to secure the support of 30-40 Members of Parliament, and 20-25 other elected officials from across Canada. This is much greater than any previous transfer applicant, by far. MP's from the New Democratic Party, Liberal Party, and of course Elizabeth May of the Green Party should be approached especially, as they are most likely to be supportive. If you live in a riding represented by the government (i.e. a Conservative), you are very much encouraged to urge them to approach the Minister of Public Safety in support of my transfer application. You can indicate to any MP that their participation (or not) will very much influence your vote in the 2015 election.

Once the Canadian Ministry of Public Safety has been informed of the US DOJ approval, we will urge you to again contact the Minister and your elected representatives – politely, of course, as rude or threatening calls won’t help – to get them to tell the Minister to approve the transfer.

If, after 28 days, there is no answer, a nationwide phone blitz for one specific day will be announced (well in advance), where hopefully thousands of Canadians will spend as much of that day as possible calling every phone number at the Minister of Public Safety, and every office on Parliament Hill of every Conservative MP, and every Conservative MP constituency office across Canada. This will be done every 14 days until the minister approves the transfer. If he rejects the transfer, the phone barrage will continue every 14 days, urging him to reverse this decision. For that campaign to be effective, we need the support of thousands of Canadians, who can keep the phone lines busy for nine hours straight on those targeted dates.

Ideally the phone jam campaign won’t be necessary, as we hope to have my transfer application quickly approved by both the US and Canadian federal governments. It depends on you to help make that happen! Thank you in advance for your support.

This blog in mid-January is to inform anyone reading this how the transfers work and how the campaign to repatriate me to Canada will be done. To make it happen I will need you and as many people as you can round-up to help out in the ways indicated. Marc’s Christmas Prison Blog

submitted by on December 23, 2012

Marc and Jodie Emery in Yazoo City prisonI had some additional thoughts about Michael Coren's Sun TV interview with my wife Jodie and his subsequent Toronto Sun newspaper rant (both are attached to the beginning of my last blog) about me and the cannabis culture.

One of the favoured media propaganda techniques is the long ranting monologue preceding the interview of the guest (Jodie in this case) with opposing ideas. This rant (perfected by Bill O'Reilly at Fox News and emulated in this case by Sun TV host Michael Coren) is always full of idiotic lies. What do you say to someone who is arguing the world is flat? Well, you don't get to say anything because the guest isn't present during the taping of the rant, and doesn't know it will show up in the broadcast. And even if Jodie were aware of the rant, how can you rebut a dozen lies in nine seconds?

As for the tacked on interview with Jodie, it's a matter of the host skipping from subject to subject whenever one subject gets too hot. When Jodie brought up prohibition's role in starting wars, justifying invasions and directing foreign policy, Coren tosses in a quick lie and zips off to another subject.

Coren says he can't see why marijuana prohibition is a big cause (despite it being big enough for two states to vote in the majority to repeal marijuana prohibition). Again, Jodie starts to tell him how prohibition affects nearly every aspect of society and zip… lie… zip… he's off to another subject.

What has Coren ever read about prohibition? There are dozens of books cogently explaining the hundreds of thousands of prohibition murders and deaths, the narco-states, the corruption of whole militaries and police, cartel slaughters, massive incarcerations; is it possible a modern day man with access to so much information could be so blithely unaware?

No issue is bigger than prohibition: wars, invasions, drug cartels, repressive narco-states, civil wars, gangster governments, corrupt law enforcement, over 60,000 dead in Mexico in six years, loss of privacy in a police state, seizures of homes and kids, denial of miracle medicine to those in pain and misery, orphaned children, millions of destroyed lives, demagoguing politicians, drug cartel money propping up the world from total economic collapse in 2009, and 75 years and counting and prison, prison, prison.

Could it be Coren and people like him are just propaganda robots who automatically reject anything coming from the reality-based community? Whenever the 'reality-based community' brings up a point, the reaction is to dismiss it with some moronic lie, and then …zip… to move on.

Jodie Emery and Michael Coren on Sun TV News MediaThe camera, when left alone to do its work, doesn't lie. Jodie came across as a classy, intelligent person who dealt in facts. Coren comes across as a brainwashed ideologue grinning at his own stupidity, which he mistakes for intelligence. Coren, knowing full well how full of it he is, even predicts he will get loads of emails and twitter responses from the reality-based community calling him "evil". Coren doesn't see the relevance of his own remark. He laughs at it.

It is this disconnect between the evil done by prohibition and the inability of people like Coren to accept responsibility for what they are endorsing. This is sociopathic behaviour. Coren simply can't empathize with the suffering he is promoting. Prohibition is no more serious a concern than "the right to masturbate", he writes!  It is indeed true with prohibition, that if you aren't against prohibition, you are indeed for it – and therefore must accept the evil done by prohibitionist policy as your own. Prohibitionists are incapable of logical thought in this matter because logic would show they are supporting evil acts. Therefore, Coren avoids logic, and avoids any responsibility for who he is, and what he is.

Coren's mistaken assertion that police ignore possession busts is limited and incorrect. Incorrect because, as Jodie points out, possession busts continue to rise, over 10,000 in Canada last year. But limited, too, because the big prohibition money for police is in seizures. That's the main interest of police when it comes to prohibition. The police don't get homes and cars and yachts and motorcycles and computers and furniture and anything else they want by making possession busts. Would-be-uniformed thugs don't join police SWAT teams to make possession busts. They join to fuck shit up. To blast through front doors, to toss in stun grenades, carry heavy assault weaponry, wear intimidating black assault outfits, have slavering German Shepherds ready to attack anyone inside feigning resistance. Helicopters, tanks, all the SWAT team paraphernalia so beloved by adrenalized cops everywhere in North America – you don't get that making possession busts.

Seizures and the new asset forfeiture laws that allow them are the biggest part of the corruption. As in the United States, Canadian police are now addicted to marijuana prohibition because of forfeiture and seizure laws. Like the US, seizure laws have created a profitable industry for police in Canada. Some US police departments exist only because of seizures.

When drug-related asset forfeiture laws were first introduced in Canada, it was made clear none of the proceeds would go to police. This was done to avoid corruption. That quickly changed, and so did Canadian policing. Asset forfeitures are used to finance police asset forfeiture infrastructure. Busts are now equated with personal and institutional benefits that can be obtained no other way. Corruption is guaranteed. Police become armed robbers with a badge.

Coren asked Jodie if she was a 'pothead', a juvenile tactic that says a lot about Coren and his audience. Coren seemed to be in a constant state of self-absorbed glee through the entire interview. He was so charged up while saying the dumbest things and was just bursting to say the next dumb thing, and the next.

A classic remark by Coren had a certain historical resonance, his final last-stand defense for prohibition and all it represents. When the lies don't hold up (and they didn't), when the facts are starting to get in the way (and they did), it's time for the ultimate rationalization, the one that is history's most popular justification for evil: "Well, it's the law."

Marc Emery in Yazoo Prison for Christmas Then at the end, Coren wishes me the best for the holiday season. See, that's a disconnect. He can't see legalization as a worthy cause, he thinks I doth protest my five-year sentence for selling seeds from my desk in Vancouver too much (there are more worthy prisoners and causes, he says), he issues me a robotic Christmas greeting to show his humanity while expressly supporting the propaganda from a prohibitionist system that put me in a US federal prison in the first place! That's chutzpah for you!

The prohibition system has left over a million children without fathers in the US, and millions more in some level of despair over loved ones in prisons worldwide for prohibition. Coren and drug war apologists will nonetheless enjoy the holidays with their families. He does not see the evil, the contradiction. It does not enter Coren's mind. Simply by wishing me a Merry Christmas, Coren is able to reassure himself he is an okay guy. After all, prohibition can't be so bad as to ruin a Merry Christmas, can it, Mr. and Mrs. Emery? What's 2,600 kilometers separation, really, for five years, because of some seeds?! Merry Christmas, Marc and Jodie – come on, lighten up, says Mr. Coren; It's Christmas, for goodness sakes!

————————-

But I'll be out soon, maybe 12 months if I get transferred back to Canada, 18 months if I don't. The Prohibitionists, however, are forever locked inside a delusion they can never escape. Abandoning that delusion, they'll have to see themselves as they really are. And that's something they can't handle. Therefore, their lives will continue to be an exercise in worthlessness. But enough of Michael Coren at Christmastime.

Christmas brings a feeling love and hope for humanity. People warm up at Christmas. They are nicer to each other for a brief period of time. I know from letters and cards that I am thought of at Christmas by many, and it's a comforting feeling. All my work of over 30 years is coming to a big pay-off. Two US states have legalized, with many more (and hopefully British Columbia) on the horizon to legalize. Uruguay will legalize next year. The juggernaut is loose and cannot be turned back, though the prohibitionists will certainly try.

Let us hope for Happy Holidays, and in the New Year, begin the hard work anew on Legalization with Peace on Earth, and No More Drug War.

Merry Christmas,
From Marc Emery

Marc Emery’s Response to Michael Coren of Sun Media

submitted by on December 19, 2012

Marc Emery: Free The People Marc wrote this prison blog in response to an offensive, inaccurate attack column against Jodie, Marc and all marijuana legalization activists written by Michael Coren, a columnist and TV host for “Fox News North” Sun Media. Coren has had Jodie on his TV show three times, but the third appearance resulted in an online backlash against him, leading Coren to write this column.

Watch Jodie’s appearances on Coren’s Sun TV show; the third is the most recent one, which began the controversy (you can also watch the videos at the bottom of this page):

My Response To Michael Coren
By Marc Emery

The two greatest cultures on Earth that have done most to enhance the lives of people of the planet in the last 100 or so years are the Jewish culture and the cannabis culture, two historically demonized and persecuted peoples.

The Jewish culture is remarkable in that such a small relative population currently numbering no more than 30 million people worldwide (a little more than half a percent of the current 7 billion population) has not only endured murderous pogroms* in Europe for 500 years (1450-1950), but in the last century Jewish individuals were recognized with 105 Nobel prizes for achievements in science, economics, chemistry, physics. Consider that Islamic culture, of which there are over one billion people on Earth, or 14 percent of the world's population, has won only 3 Nobel prizes in the same 110 years, and one of those went to Yasser Arafat.

(*Pogrom means an organized campaign by government to demonize and persecute an identified minority with a larger society. Originally a Russian word, it is now part of the English language. It is identified most closely with the persecution of Jews in Russia from 1820 to 1917.)

Jewish people have been prominent in all aspects of business, science (biology, disease control, vaccination, chemistry, physics, electricity, and many more sciences), aerospace, technology, industry, film, journalism, literature, theatre, and computers. The impact by Jewish people in human advancement is stunning by comparison with all other races, religions, or cultures – except one, the Cannabis Culture.

Although Shakespeare, the greatest writer in the English language, was a proven cannabis consumer, the staggering achievements of the cannabis culture are most noticed in the last 60 years, particularly in the fields of music, literature, film, theatre, science, art, technology, computers, architecture, astrophysics, and business.

The number of marijuana consumers on Earth currently number about 200 million, despite the arrest and incarceration of 30 million of the cannabis culture worldwide since 1961, when the first universal law of prohibition (The Single Convention Treaty on Narcotics) was signed into law by all member states of the United Nations. It is believed 60,000 people have been murdered or executed by the police and enforcers of prohibition worldwide for offenses that were exclusive cannabis related, since 1960.

In Canada, since 1967, over two million Canadians have been arrested for cannabis-related offenses of the law; over 300,000 of these individuals served time in jail. In the United States, since 1966, 26 million Americans have been arrested for cannabis related offenses, and over five million have spent time in jail after these arrests. In New York City today, 50,000 citizens are charged with marijuana offenses annually, and in Canada, over 10,000 are charged with marijuana possession offenses annually.

I myself am serving five years in a US federal prison for (ostensibly) selling cannabis seeds from my desk in Vancouver, despite never having left Canada while doing so, but the head of DEA said in the press release the day of my arrest that it was all about my political activity for legalization. In fact, our Freedom of Information Act request to get my file from DEA revealed that they had in fact tracked over $2 million dollars in my contributions to activist organizations and individuals operating in the United States, including ballot initiatives in Washington, DC (1998), Colorado (2000), Arizona (2000), Alaska (2000, 2002, 2004), class action lawsuits against the US government (1999), and over 200 other campaigns.

When I was arrested in 2004 in Saskatoon, Saskatchewan for passing one joint, and sentenced to three months in provincial prison (much to my surprise, as the police had seized no marijuana, having only a witness who said I passed a joint to a 22-year old person), I had my first incarcerated experience of the drug war and spent much time studying its pernicious underpinnings.

I read then a book I consider the greatest study undertaken to understand the drug war, and it greatly influenced me then, and still does to this day. I have never found a book more insightful as to the true nature of our enemies, the Prohibitionists, as I have in the book DRUG WARRIORS & THEIR PREY by Richard Lawrence Miller. There simply is no more important book about the drug war and why the cannabis culture, and by comparison in the book, the European Jewish culture, were both targeted for destruction and elimination by the dominant governments of the times, the cannabis culture by the American and Canadian governments from 1969 to the present, and the European Jewish culture by almost every central and eastern European government from 1900 to 1945.

It explains the four processes of culture annihilation that both The Marijuana People and The Jewish People faced (and face) in their respective culture.

These four processes, approved and codified in laws affecting every aspect of North American life today for the cannabis culture and every aspect of Jewish European life in the 1900 to 1945 period, are, in order:

1. Demonization
2. Ostracization
3. Segregation & Terrorization
4. Concentration

In the Demonization process, the government engages in propaganda to condemn the cannabis culture or Jewish culture as deviant, impure, corrupting to youth, foreign, unpatriotic, unhealthy. Conservatives in both the United States and Canada wage every campaign of the last 35 years as an attack of the cultural values of the 1960's. Stephen Harper has launched his pogrom against the cannabis culture in Canada by specifically identifying the culture of the 1960's, with its cannabis-inspired music, theatre, poetry, sexual freedom, anti-authority journalism, dissent, environmentalism, anti-war ethos.

(From Marc's prison blog from 2009, "Stephen Harper and the End Of Days (of Canada As We Know It)": Marijuana use represents everything Stephen Harper wants eliminated from acceptable Canadian society. Harper, when launching the National Anti-Drug Strategy on October 4, 2007, cited permissive values of the 1960's when launching his latter-day crusade against the infidelsclick here to watch the video: "A simple war on drugs is not going to be successful," he said, "but neither is simply being soft on the question going to be successful. We are up against a culture that, since the 1960's, has had at the minimum not discouraged drug use and often romanticized it, or made it cool. My son is listening to my Beatles records and asking me what all these lyrics mean. I love these records. I'm not putting them away. But we have to change the culture.")

Governments in Europe in the 1930's and governments in the periods 1970-present in North America used the schools to encourage children to turn in marijuana people, propagandizing all students with absurd, unscientific hate spiels. Governments buy ads on television, radio, newspapers, entirely with the cowed compliance of all media in both countries, to assert fictions designed to separate the cannabis culture from being regarded as first class citizens. Jews and the cannabis culture are asserted to be different from 'regular' citizens, not entitled to the constitutional protections that other citizens receive. Jewish culture and cannabis culture are in fact, peaceful and honest lifestyles harming no one, so the government needs to put a wedge between the dominant culture and those targeted for persecution.

After the propaganda campaign comes the changes in laws that affect every aspect of life: the ostracization by law. Jews and the cannabis culture that do not hide their cultural affiliation cannot be teachers. They cannot be judges. They cannot be policemen. They cannot hold elected office. They cannot be bonded. They cannot get security clearance for sensitive government jobs. They can have their children taken from them for 're-education'. They cannot travel to neighboring countries. They get urine and blood tested before being considered for most jobs in industry or the federal government (European Jews were not required to submit to this), and if they are verified as part of the Jewish or cannabis culture, they are eliminated from consideration for employment. They can be refused public assistance in the form of welfare, food stamps, public housing, student loans, student grants, admission to universities and colleges.

In North America, neighbors, utility inspectors, fire inspectors, municipal zoning officers, postal delivery people, are all organized to inform to the authorities if anyone in the cannabis culture house is suspected of having cannabis plants in the home. The parents must advise the children never to discuss the use of cannabis or the existence of plants/Jewish rituals in the home with anyone else, or the state and its agents will seize the children, seize the home, and/or arrest the parents. The police are empowered to destroy or seize the home and the contents of the home. Notices can be posted outside the home on the front lawn, by police, that say, "drug house"/"Jews" and all neighbors encouraged to ostracize the cannabis culture/Jews living therein. Landlords are informed and certainly urged by authorities to evict the cannabis culture/Jewish family immediately. The media are advised, and the cannabis culture/Jews will have the police visit publicized. Employers will be encouraged by this media exposure to fire the cannabis culture person/Jews from their employ, lest the business be tainted by bad relations with the state and propagandized population.

The necessary corollaries for the propaganda and demonization campaign are severe laws punishing the practices of the cannabis culture through Prohibition. All aspects of the cannabis culture are prohibited, whether banning the implements of use of cannabis, or material to cultivate cannabis, or any aspect of its distribution. These prohibition laws manufacture millions of 'criminals' overnight; the laws of the state virtually manufacture crime where previously there was none – manufacturing criminals where previously there were none. 'Crime' organizations instantly exist to re-create the previously unhindered legal use and distribution. This has the necessary effect of creating violence within the cannabis culture, as what was previously of almost no financial value becomes an extraordinarily lucrative commodity. Demand remains constant while production is now entirely moved underground, the scope so vast as to permit the state to relentlessly increase the size and scope of its police repression with unquestioned and virtually unlimited annual increases in taxpayer revenues.

Once the full effect of laws are applied at the municipal level through safety inspections, utility inspections, at the state/provincial level through employment tests (urine, blood, social media, government contracts), Child Protection Agency inspections, and road-stop inspections, at the federal levels through pervasive legislation, government mandated blood and urine tests, then the state unleashes its full fury through militarized and violent assaults on the cannabis culture/Jewish culture. At this point, SWAT teams, fully militarized armed and masked agents of the state, routinely (meaning daily) smash into peaceful dwellings, immediately killing pet animals and threatening to kill everyone inside if they do not immediately submit to being laid on the ground, roughed up, handcuffed and led outside.

The modus operandi of the current terrorization of the cannabis culture by state agencies in Canada and the US is virtually identical to the European persecution of Jews. Police have full reign to wiretap, surveil, use any level of force, destroy as much property with impunity, have the residents evicted, seize the property by outright forfeiture, the children sent to re-education centers away from the custodial care of the parents. Then in order to re-occupy the home, the residents must submit to extortion by municipal electrical, safety, and housing inspectors, costing upwards of tens of thousands of dollars to meet compliance with rules specifically passed into law to harass and humiliate the cannabis culture family.

The popular media is then enjoined unquestioningly to trumpet the heroic efforts of the police who seek out and rid the community of "vermin" Jews/cannabis culture. The media never question the premise of this daily police violence; the federal government regulates television networks, and the private newspapers, always desperate for revenue, rely on a constant infusion of government advertising revenue.

Once the terrorization has been underway, the cannabis culture/Jews are arrested and placed in prisons, for increasingly longer sentences, under continually deteriorating or inhumane conditions of over-crowding, substandard food, violence by guards and other 'criminals'. It happens with such daily frequency the 'regular' civilian population pays virtually no attention. Police have absolute power, government ministers are immune from any consequences of their systemic cultural destruction, and the cycle is now well on its way to the conclusion of the deliberate campaign by government, the elimination of the cannabis culture/Jewish culture entirely.

For what is the ultimate intended effect of the marijuana prohibition by the US and Canadian federal government? It can only be the total and utter destruction of the cannabis culture through demonization, ostracization, terror, and finally elimination. What was the ultimate goal of the many central and eastern governments in Europe in regards to the existence of Jewish culture? There are few or no Jews in Germany, Poland, Romania, Bulgaria, Russia, Hungary, and Greece, where there were over six million before 1935.

The question before the North American cannabis culture for the last 45 years has always been "how far will you let the governments of Canada and the United States go before the 4-stage cycle of cultural annihilation is complete?"

The Jews of Europe and the Cannabis Culture of North America asked the same question during their brutal ordeals of arrest, imprisonment and worse: "Why do they hate us so?"

There is only one answer, and the answer is: The State likes the cruelty, the grotesque exploitation of power, and the immoral lust for dominance. Why else be a cop? Why else be a judge? Why else be a politician? Why else to use unlimited and unearned power over the lives of others to dispose of their peaceful and honest lives at whim?

"But why us? We have so much to offer!" cried the Jews and the cannabis culture. And the state replies, as they have not ever one rational basis for this mass abuse of the Jewish people and cannabis culture, "You must suffer precisely because you are so good and have given so much, and we are so unworthy of what you have contributed to our lives and so we spite you to put you in your place, you are and always will be subservient to us, if we even let you live!"

**********************

As an activist for the end of the prohibition of cannabis and the end to the pogrom by the governments of Canada and the United States toward the cannabis culture, I was arrested 28 times from 1996 to 2010, all for cannabis-related offenses.

I was arrested when a police SWAT team of the Victoria, British Columbia police raided my home with my then-partner and her child at 4:00am one early morning in January 2003, ostensibly looking for plants. There were no plants, and the police grounds for a warrant were completely fraudulent and invented. I was arrested six times and jailed on my Summer of Legalization Tour in 2003 when I was legally (according to Canadian law at the time) smoking a bong in front of the Calgary, Edmonton, Winnipeg, Regina, St. John's and Moncton police depts. (Charges were all dropped, as I was right that the law didn’t exist then.) I was arrested when police SWAT teams raided the offices of Cannabis Culture Magazine, and my HEMP BC store, in January 1996, December 1997, April 1998, and September 1998. I was arrested and jailed for 68 days for passing one joint in Saskatoon, Saskatchewan after speaking at the university of Saskatchewan in March 2004. I was arrested and cuffed by the highway for having four grams in my possession in July 2003. I was arrested on July 29, 2005 by the Royal Canadian Mounted Police at the behest of the US DEA and with the complete collaboration of the Canadian federal government, and sentenced to five years in a plea deal instead of getting thirty years to life and dying behind bars.

So I know about the abuse of power at the pernicious whim of authorities.

Every Justice Minister/Attorney-General of Canada since Pierre Elliot Trudeau was Justice Minister in 1967 is a party to this pogrom so severe as to be unforgivable and its immorality inerasable from the historical record. The same is true for Attorneys-General of the United States. The Presidents and Prime Ministers of both countries who permitted such a brutality against millions of citizens to occur on their watch are fully guilty of a crime against humanity and all still alive should be brought to trial and prosecuted.

This includes Justice Ministers of Canada Kim Campbell (Mulroney government), John Turner (Trudeau government), Jean Chretien (Trudeau government), Rob Nicholson (current Conservative government), and Irwin Cotler (Paul Martin's government) and all others who served as Justice Minister and permitted this prohibition abomination to persist.

Irwin Cotler was Justice Minister when one of his minions in the court of Saskatoon, Saskatchewan sentenced me to three months in prison for passing a joint in March 2004.

When anyone from the cannabis culture reaches elected office, the responsibility on that person, having once been part of a persecuted minority, is much greater than that of any ordinary person. The elected person from the cannabis culture retains intimate knowledge and experience as to how insidious and abusive the arbitrary authority of government can be. So when someone from our culture reaches elected office, the betrayal is far more egregious if that person becomes a prohibitionist drug warrior. It is unforgivable and the greatest treason to decent human values as well as a complete negation of morality. That person is more evil because they know better, but for power and lust of domination, they betray us and become our worst enemy. In this class we can include many politicians, but certainly President Barack Obama.

So too is the responsibility for any Jewish person who achieves power in government, particularly a Justice Minister or Attorney-General. When a Jewish person turns his back on his collective history of persecution and becomes the channel for mass persecution of those exercising peaceful and honest lifestyle choices, he becomes a cipher for pure evil.

In this regard, you have to ask yourself, as I did in September 2004 while serving a three-month prison sentence in a Prairie gulag a thousand miles from home, what do you call a Jewish human rights activist who, as Justice Minister, betrays the principles of decent humanity for arbitrary punishment and power? Do you call him a Nazi Jew or a Jewish Nazi? To me, there is no doubt about his capability and capacity for evil as a government agent; the only question is the appropriate terminology to describe his perfidious deal with evil. And so I wrote that in my prison blog while serving that incarceration in September 2004. My diary thoughts on what was the appropriate description to refer to Irwin Cotler were never printed anywhere, and in fact, you can't find my original daily diary notes of that incarceration anywhere – which is quite unfortunate, because my writings from August 20 to October 19, 2004, the period of incarceration (I served seven days in March 2004 awaiting bail) produced some of the best work I have ever done.

Ten months later, the Liberal Justice Minister Cotler, in collaboration with Republican President George W. Bush's Attorney-General Alberto Gonzales, signed on to the extradition request of the United States seeking to imprison me in the US for my political activities.

In May of 2010, Conservative Justice Minister Rob Nicholson handed me over to Democratic President Barack Obama's Attorney-General Eric Holder's US federal justice system to be incarcerated for a five-year sentence, despite never having gone to the United States.

Michael Coren's column in the Toronto Sun ridiculed and insulted me, my wife Jodie, and the rest of the legalization movement. It's such a pity that a man who prospers free from persecution can so easily cast away the collective past history of our people. In 1983, I wrote a biography of a woman from my hometown of London, Ontario – Fanny Goose – who escaped the Holocaust in Europe, seeing every member of her huge family murdered. It's a compelling and riveting story, a triumph of her spirit during a staggering, horrific ordeal. The lesson of the holocaust is 'Never again'. Not for anyone, anywhere, of any peaceful and honest lifestyle, to suffer the arbitrary cruelty of immoral government power. Not for race, not for religion, not for the plants you grow in your home, or backyard. Not for your beliefs or peaceful lifestyle. No way, no how, not ever again.

Cannabis Prohibition has been abusive to well over 30 million North Americans (and I do not, for lack of statistics, include Mexico or Central America here, but more's the tragedy, one can be certain) in the last 50 years, and Michael Coren thinks it is no more than a parallel "to the right to masturbate".

He's wrong. Never Again. Not now, not ever, no way, no how, can he make prohibition and its persecution in any way legitimate. He's a disgrace to his journalistic profession, as a Canadian. Michael Coren is an apologist for the powerful and cruel. He spits on the persecution and injustice meted out to myself, and my people. For that, he is loathsome. He should know better.

The History of Marc’s Prison Bands Behind Bars

submitted by on December 13, 2012

Marc's prison band It’s December 6 today, I've got 4 months until I get my transfer-back-to-Canada application to the Department of Justice in Washington D.C. It’s 580 days to go if I serve my entire sentence here in the US federal prison system (up to July 9, 2014) with 1,010 days now served – that’s 33 months done, 19 to go (on a 60-month sentence, I'll serve 52 months with my good time credit).

My band, Yazoo, performed its eleventh concert on the afternoon of Saturday, November 24. Our set list turned out to be 20 songs in just over 2 hours. I've been playing a bass guitar just over 18 months now, having never played any instrument in my life prior to coming here to Yazoo City federal prison (one of the inspirations for the name of the band, which I chose, since it’s my band). I remember shortly after my arrival picking up a guitar on May 7, 2011 and deciding to learn the instrument.

I struggled and showed no talent, but on the tenth day, a guy named Grizz who was in this amazing band I had heard in concert in my first weekend here noticed I was giving it a try, and said "Have you ever considered learning the bass guitar?"

"Uh no, should I?" I said.

"Well, I think our band is going to need a bass player shortly, and if you worked on the bass everyday, I'd teach you, and you could be in our band."

I was dumbfounded. "You mean, I could be in your amazing band if I started learning the bass????!!!!"

"Yeah, it shouldn't be too hard."

Rock and roll fantasy overruled my trepidation, and I said yes. So Grizz, a guy who'd been inside 30 years (1982 to 2011) with swastikas and white power tattoos and slogans covering his entire arms, patiently and kindly and expertly taught me bass guitar starting that day and every day for 2-4 hours, always outside, often in 100 degrees Fahrenheit days for weeks on end. Despite the tattoos and Grizz's gruff persona, I never heard him say an insulting word about anyone in all the time I knew him. He said he'd left that confrontation part of his life (the swastika/white power stuff) behind him.

Six weeks later on July 2, 2011, I performed live my first concert, 8 songs, including All Along the Watchtower, Purple Haze, Sunshine of Your Love, Tightrope (SR Vaughan), and Johnny B. Goode. I only was able to do root notes, but I got through it okay, and I was pleased that I was a 'musician' now. Grizz was the bandleader, and a great bassist, but Grizz wanted to be the singer in the band and play rhythm guitar, Terry would be the lead guitarist, and Sapp would be the drummer, so that’s how I got the job on bass. The name of the band was 'Stuck' (as in 'Stuck in Prison').

Oddly, within a few weeks of working together, he made me assistant band leader (though I knew virtually nothing at the time about the mechanics of music or being in a band) and he had the band paperwork amended to say that. "In case something happens to me, you can keep the band going," he said.

Well, by August, just before our second concert, something did happen to Grizz. The prison assigned him a new cellmate, one whom, it was said, has a sex offense. Well, Grizz was very old-school, spending most of his 30 years inside in penitentiaries (maximum security), and he could not be the cellmate of a sex offender. Grizz had actually received an additional ten years to his remaining prison sentence for stabbing a sex offender nearly to death; in this situation Grizz tempered his instincts and merely said to the new cellmate, "you can't be in here with me, you have to roll up." In prison, to 'roll-up' means to turn yourself in to protective custody, which is solitary. But when someone here is forced by other prisoners to 'roll-up', the prison demands to know who pressured you to 'roll-up', otherwise they won't put you in protective custody. So that day both the so-called sex offender and Grizz were taken to the SHU (solitary housing unit), and after several months in solitary for each, both were transferred to other facilities.

Then my drummer Sapp got into a fight, so he went to solitary for two months. So in August last year I was missing my drummer and bandleader/vocalist/rhythm guitarist. The band went through some adjustments, merging with a reggae band for two months, doing Bob Marley songs like I Shot the Sheriff, No Woman, No Cry and Stir It Up.

Then we reformed our original group, as Sapp came back, we got a new vocalist, and the band became Yazoo (because it’s where we met, where I learned bass, and where we practice and play). We got a singer named Victor, who also played rhythm guitar. In that period, we played country songs like Out In The Backwoods, Killing Time, Don't Blink, and Way Out Here and rock songs. By this point I was no longer doing songs in root notes, but full proper bass lines, but my notes weren't ringing out enough and I wasn't always very smooth.

Victor decided to strike out and form his own band about a year ago (he still hasn't ever got a band successfully together, but we're still friends and he's a great talent), so we got soul singer named Trece as our vocalist and went through a period of soul/R&B songs like Sittin on the Dock of the Bay, A Change is Gonna Come, Stormy Monday, Easy Like Sunday Morning. Trece was released from prison at the same time as our rival band 'Out of Bounds' broke-up when their drummer/singer was transferred, so Chap the bass player and Don the guitarist from Out of Bounds joined us back in March, and that’s been our line-up since: Chap singing the vocals, I play bass, and Don and Terry do alternate leads on guitar.

It’s a pretty amazing band now, and I can't believe I'm in it. I've practiced every day for over 18 months and I've really gotten much better. My finger memory is way improved, my notes ring out, and I can be taught a song often in just two or three afternoons. Sometimes, like with Texas Flood (by Stevie Ray Vaughan), or Heartbreaker/Living Loving Maid (Led Zeppelin), it takes me 30 days to get it right though. Just today, in my afternoon practice I was doing Money by Pink Floyd and I sounded so much better than six months ago – it’s been that long since I even practiced it, and I sounded much better just doing it out of the blue after that huge absence than I used to sound, even when I practiced every day for weeks back then.

I practice on an acoustic bass every afternoon, which is kind of largish and a little awkward to set comfortably on one's thigh to play, and then on Monday evenings we rehearse as a group our songs that we've been practicing on independently. Terry and I always practice together every afternoon, and Don and Chap often work together in the evenings, and all five of us put it together Monday nights from 5:30 to 8pm in the wonderful electric band room with amplification and electric bass and guitars. I play with a Carvin bass to a Carvin amplifier on Monday nights and in concert. When I get out I'm going to buy an electric Fender Precision Select bass.

Marc's prison band poster by Gary WintleOur set list on November 25 was:

1. Running Down A Dream (Tom Petty)
2. Come Together (Beatles)
3. Black Magic Woman (Santana)
4. Jumpin Jack Flash (Rolling Stones)
5. Blue on Black (KW Shepherd)
6. Heartbreaker/Living Loving Maid (Led Zeppelin)
7. Too Young (Garth Brooks)
8. Turn the Page (Bob Seger)
9. Pride and Joy (Stevie Ray Vaughan)
10. Texas Flood (SRV)
11. Plush (Stone Temple Pilots)
12. Crazy Train (Ozzy Osbourne)
13. Sweet Home Alabama (Lynyrd Skynyrd)
14. Sunshine of Your Love (Cream)
15. Enter Sandman (Metallica)
16. Hey Joe (Hendrix)
17. Purple Haze (Hendrix)
18. Red House (Hendrix)
19. White Room (Cream)
20. Whole Lotta Love (Led Zeppelin)

It was a beautiful clear, sunny afternoon and I was pleased with how the concert turned out, my only real difficulty was a cramp in my right hand (where my index and middle finger alternate hitting the strings) when Terry did an eight-minute lead guitar solo at the end of Whole Lotta Love, and as the bassist I do the riff B-D-B-D-E E-E E-E throughout most of the song, including the solo, and I just had to stop and hit the low E string for a minute before coming back in the riff once the cramp subsided. After 130 minutes of playing, I was tapped out!

Since Terry, Don and Chap are very experienced musicians with 28, 12 and 13 years respectively of regular playing to their credit, we agreed to scrap our existing repertoire for the next concert and develop a new set list, because they are a bit bored of playing the same songs with only three news ones each concert. So for the January concert (we're going to pass on a Christmas show, we won't have the new songs all ready), here's our set list, each of us choosing three new songs plus keeping Running Down A Dream, Texas Flood, and Turn The page, which we've only done once in concert:

I chose:
Smoke on the Water (Deep Purple)
Stray Cat Strut (Stray Cats)
Beautiful Day (U2)

Chap chose:
Your Disease (Saliva)
Isolation (Alter Bridge)
Last Resort (Papa Roach)

Don Chose:
All Right Now (Free)
Simple Man (Shinedown)
Kryptonite
(Don will sing these three while Chap plays guitar on them with Terry)

Terry chose:
Surfing With An Alien (Joe Satriani)
Boys Are Back in Town (Thin Lizzy)
Eruption/Ain't Talkin Bout Love/You Really Got Me (Van Halen medley)

I've already got the bass down for Boys Are Back in Town, Last Resort, Simple Man, and have a grasp on but need to do hard work on Stray Cat Strut, All Right Now, Surfing With The Alien (this is a fast song!!!!!) and the two Van Halen songs (Eruption is just a lead guitar). Then on to the remaining five!

I want to say thank you to the amazing people of Alberta's cannabis community who held their third annual Christmas fundraiser for me in Lethbridge, and raised a record amount of $1,680, which I am extremely grateful for! That will pay for my commissary (food, toiletries, clothing), phone and email, music downloads, photo copies, and postage for two full months. The first fundraiser was organized by Tamara Cartwright and Fiona Doherty, and Fiona is carrying on the work with other local activists. They have all been supportive for years, including my time on the Farewell Tour of 2009. Thanks to Fiona Doherty, Austin and Dana, the sponsors and stores who contributed, and the hundreds of people who came together to make this event fun, magical and so helpful to me. So I promise them that once I get out, I'm hoping to work with musicians, develop a song set list, put together a band and make my first public musical performance outside of Vancouver in Lethbridge, Alberta!

The two things that I'm proudest of about my time in prison is how Jodie has risen to the challenge and become the best she can be in activism and business management, and how I’ve developed as a musician. When this difficult time for Jodie and I is over, we will both have new capabilities and skills that we both otherwise would not have developed. That is the essence of successfully dealing with adversity: showing improvement and advancement as a result of the ordeal.

I can't wait to see that poster in Lethbridge, "Saturday Night! Speech by Jodie Emery, Music by Marc Emery & Friends!"

From Yazoo federal prison,
In Yazoo City, Mississippi,
Marc Emery

Marc Emery on Ron Paul: “The Great Man Has Left The Building”

submitted by on November 25, 2012

Ron PaulRon Paul, my hero and great political and moral influence, gave his farewell speech to Congress on November 14th after 23 years of serving as the lonely, often marginalized, voice of reason and stalwart of constitutional principles in the House of Representatives.

In those years Ron Paul always voted against any financing for the drug war and the drug czar's office. He sponsored bills to legalize possession of marijuana, industrial hemp, and medical marijuana; a Truth in Trials Act, allowing introduction of state medical marijuana laws in federal trials; bills to end the US military empire abroad, Plan Colombia, the Patriot Act (and not voting for it in the first place), and the School of the Americas at Fort Benning, Georgia (training of foreign military elite in torture and repression). [See the video clips and more links about Ron Paul's position and action on marijuana and the drug war in Marc's December 2011 blog post: "Support Ron Paul for President!"]

Never did Ron Paul ever vote for or support any legislation that restricted our liberties, allowed government secrecy, carried out the war in Iraq, maintained the US military abroad, expanded surveillance of the US people, debased the money, raised taxes, imposed censorship, or any other unconstitutional incursion into the rights of the citizens or the states.

He has been the greatest Congressman in the history of the United States, for he was, and is, the only true patriot to ever have served in the Congress honoring the US Constitution in a devotion that was, thankfully, fanatical and unwavering.

You must watch and/or read Ron Paul's farewell speech. (Click Here or watch the video at the bottom of the page.) It is one of the vital documents of our time. Not a false word is spoken or written. Clearly and plainly, Ron Paul explains what went wrong, why liberty is fundamental to all of human success and progress, asks all the right questions, and lays blame appropriately – at the feet of government and the citizens who enable governments to do so much of the evil that gets done.

When I first read Ayn Rand's "Capitalism: The Unknown Ideal" in October, 1979, and changed the philosophical course of my life to reflect those values, I asked my new friends who had introduced me to the book, "Does anyone in politics actually adhere to these principles? " Yes, he said; "a Congressman named Ron Paul".

In the US presidential election weeks ago, the media seemed to have a field day denigrating the philosophy of Ayn Rand as part of their smear/criticism of Vice-Presidential candidate Paul Ryan. Yet Paul Ryan is a warmonger, a devout Roman Catholic, and an adherent of the drug war. No believer in the supernatural and warfare state/Imperial American Empire could ever be a credible acolyte of Ayn Rand.

Ron Paul is the proper standard to compare Ayn Rand, although there are some differences. Ron Paul is a Christian, true, and he is opposed to abortion – though as a man who has delivered 4,000 babies as an obstetrician-gynecologist physician, it's at least understandable. But importantly, Ron Paul doesn't believe any woman should ever be punished for seeking or having an abortion. He doesn't believe the Constitution allows the federal government to criminalize abortion, and that is why he received virtually no support from the anti-abortion conservatives that Rick Santorum did. Ron Paul's influences are varied, and include Murray Rothbard, Ludwig Von Mises, Frederick Hayek, and Lysander Spooner; in fact, Ayn Rand is only one of many of Ron Paul's influences. He is a well-read individual.

I believe Ron Paul left Congress because, plainly, Congress is made up of collectivist statists (kind of a redundancy, I know) and 23 years is enough punishment. Now he is going on a hopefully long tour of universities to speak to students and his people about liberty and the nature of man and politics. I wish him well. I hope he runs for President again in 2016.

Marc Supports Ron PaulRon Paul was always the best friend we anti-prohibitionists have ever had in Congress. Never once did he ever support any aspect of the drug war. Yet most of the legalization movement chose to ignore him or pay him no respect. It makes me sad in my heart to know that most in our community – and society at large – are politically ignorant, biased, and most often plainly ambivalent when it comes to political activism, and when it came time to support Ron Paul in the primaries in 2008 and 2012, most of our people did not heed the call to help this great man, this once-in-a century man.

Even in his farewell address to Congress, he does not forget us.

His first question is: "Why are sick people who use medical marijuana in prison?"

He also asks amongst his many pertinent questions:

"Why can't Americans manufacture rope and other products from hemp?"

"Why should there be mandatory sentences, even up to life, for crimes without victims-as our drug laws require?"

"Why haven't we given up on the drug war since it's an obvious failure and violates the people's rights? Has nobody noticed that the authorities can't even keep drugs out of prisons? How can making our entire society a prison solve the problem?"

"Why do we sacrifice so much getting needlessly involved in border disputes and civil strife around the world and ignore the root cause of the most deadly border in the world – the one between Mexico and the US?"

At 78, Ron Paul is still in great health, so I hope he has many years, decades I should hope, to remind us of where we should be going, and how we can get there, and why we must put heart and soul (and money) into that effort.

It's such a disappointment that Canada has no equivalent giant in politics, no great statesman philosopher politician to give the people a clear vision of liberty and freedom. All we really have is second- and third-rate statists at best, grubby thugs at worse, in institutions under the dictatorial thumb of a soulless Prime Minister and wholly inadequate Premiers.

Ron Paul. The great man of the people has left the building.

In 2006, Marc Emery researched and created an enormous profile of the voting records of every US Congressional Representative for the Cannabis Culture Magazine "US Stoner Voter's Guide 2006". He reviewed every US Congressman and Congresswoman's position on pot and other related topics, and Ron Paul came out on top for Freedom Fighter!

From the 2006 Stoner Voter's Guide District Profiles page, by Marc Emery:

Texas – 14th District: Your US REPRESENTATIVE is RON PAUL, a REPUBLICAN. Ron Paul refers to himself as 'libertarian'.

RON PAUL IS the GREATEST CONGRESSMAN of the 109th Congress. RON PAUL VOTED CORRECTLY TEN OUT OF TEN VOTES, the ONLY PERFECT SCORE in the 435 seat HOUSE OF REPRESENTATIVES.

RON PAUL HAS CONSISTENTLY BEEN THE BEST CONGRESSMAN FOR TEN YEARS.

RON PAUL RECEIVED 175 points of a possible 185 points, THE CHAMPION OF THE CONGRESS, the highest possible grade.

RON PAUL VOTED CORRECTLY TO:

1) oppose a $25 million increase in anti-marijuana government propaganda,
2) oppose the Justice Dept. war on med pot patients in states with med-pot laws (Hinchey Amendment)saving the sick and dying from persecution,
3) oppose the reauthorization of the Office of the Drug Czar (ONDCP)
4) oppose a $287 million transfer of funds to the BYRNE JUSTICE ASSISTANCE GRANTS federal anti-drug task force program,
5) reduce the spraying of poison over the Colombian rainforest (PLAN COLOMBIA),
6) end the police state apparatus known as the PATRIOT ACT,
7) end the War in IRAQ,
8) stop a massive government bureaucracy (HOMELAND SECURITY) from forming,
9) oppose a tenfold increase in punitive fines on TV and radio broadcasters of controversial material (Broadcast Decency Act)
and
10) close an American torture school for foreign military interrogators – The SCHOOL OF THE AMERICAS at Fort Benning, Georgia.

RON PAUL is also sponsor of the TWO drug-law reform bills;
* The States' Rights to Medical Marijuana Act. This is a very important bill (H.R. 2087) that would reclassify marijuana as a schedule 2 drug, allowing states to enact medical marijuana laws without federal interference.
* H.R. 4272 – Steve McWilliams Truth in Trials Act. This bill will allow an affirmative medical marijuana defense in federal or state courts where such states have a legislated medical marijuana program.
